General Terms and Conditions (GTC)
1. Scope of Application
Processing and delivery are carried out exclusively in accordance with the following terms and conditions, in the version valid at the time of the order.
2. Contractual Partner, Language, Applicable Law
The contract is concluded with Molly & Stitch Schweiz AG, company number CHE-388.361.013, Brandschenkestrasse 130, 8002 Zurich. The contract language is German. Swiss law applies.
3. Conclusion of Contract
The customer’s order constitutes an offer to conclude a purchase contract with us. By clicking the “Buy Now” button in the online shop, the customer submits a binding offer to purchase the products contained in the shopping cart and accepts these General Terms and Conditions.
A purchase contract is only concluded when Molly & Stitch Schweiz AG sends the customer the ordered goods and confirms shipment in a second email (shipping confirmation). No purchase contract is concluded for items in an order that are not listed in the shipping confirmation.
4. Right of Withdrawal
4.1. Right of Withdrawal and Withdrawal Period
The customer may withdraw from a distance contract or a contract concluded outside business premises within 14 days without giving any reason.
The withdrawal period begins:
a) on the day the customer or a third party named by the customer, who is not the carrier, takes possession of the goods;
b) if the customer orders several goods as part of a single order which are delivered separately, on the day the customer or a third party named by the customer, who is not the carrier, takes possession of the last goods;
c) if goods are delivered in several partial shipments, on the day the customer or a third party named by the customer, who is not the carrier, takes possession of the last partial shipment;
d) in the case of contracts for the regular delivery of goods over a fixed period, on the day the customer or a third party named by the customer, who is not the carrier, takes possession of the first goods.
4.2. Exercising the Right of Withdrawal
To exercise the right of withdrawal, the customer must inform Molly & Stitch Schweiz AG of the decision to withdraw from this contract by means of a clear declaration (e.g., by email or letter). No special form is required.
4.3. Compliance with the Deadline
To meet the withdrawal deadline, it is sufficient for the customer to send notification of exercising the right of withdrawal before the withdrawal period expires to the following address:

4.4. Consequences of Withdrawal
If the customer withdraws from this contract, Molly & Stitch Schweiz AG must refund all payments received from the customer, including delivery costs, without delay and at the latest within fourteen days from the day on which notification of withdrawal was received.
The same payment method used in the original transaction will be used for the refund, unless expressly agreed otherwise. No fees will be charged for the refund.
For purchase contracts where Molly & Stitch Schweiz AG has not expressly offered to collect the goods itself in the event of withdrawal, repayment may be withheld until Molly & Stitch Schweiz AG has received the goods back or the customer has provided proof of return – whichever occurs first.
The customer bears the direct costs of returning the goods. The customer is only liable for any diminished value of the goods if this loss in value is due to handling that was not necessary for checking the condition, properties, and functioning of the goods.
4.5. Return of Goods / Execution of Withdrawal
The goods may be returned to the return address within the withdrawal period. If the goods are not returned in full, including all accessories, compensation for lost value may be claimed.
The return must be made in suitable packaging for shipment, preferably in the original packaging.

The right of withdrawal does not apply to the following contracts:
Contracts for the supply of goods which are not prefabricated and for the production of which an individual choice or determination by the customer is decisive, or which are clearly tailored to the personal needs of the customer.
5. Delivery
Unless otherwise agreed, delivery is made from the warehouse of Molly & Stitch Schweiz AG to the address specified by the customer. Information on the availability of individual products can be found on our website. If, during the processing of your order, it turns out that ordered products are not available, the customer will be informed by email.
6. Due Date, Payment, and Default
The customer may pay the purchase price by credit card or through other online payment providers. Payment must be made in the currency specified on the invoice.
For credit card payments, the customer must provide the necessary details in the order form. Molly & Stitch Schweiz AG will only deliver the ordered products once the credit card company has authorized the payment.
The invoice and the ordered products will be sent to the address specified in the order confirmation.
7. Prices
All prices include the applicable Swiss value-added tax (VAT).
8. Retention of Title
The delivered goods remain the property of Molly & Stitch Schweiz AG until full payment has been made.
9. Limitation of Liability
Molly & Stitch Schweiz AG is liable only for intent and gross negligence. Liability for financial losses due to slight negligence is excluded.
